1. Seller and contact

1. The online store at healthytouch.pl is operated by Yana Kazymyrchuk, a sole trader operating under the Healthy Touch brand, business and correspondence address: Hetmańska 4/12, 35-045 Rzeszów, Poland, Polish tax ID (NIP): 5170433338, statistical number (REGON): 524444910, registered in the Polish Central Register and Information on Economic Activity, hereinafter the “Seller” or the “Studio”.

3. These Terms are available free of charge on the website and may be saved or printed. The Seller will also send a copy by email upon request.

2. Definitions

Customer

a natural person, legal person or organisational unit placing an order.

Consumer

a natural person purchasing for purposes outside their trade, business, craft or profession; where required by Polish law, consumer provisions also apply to certain sole traders acting outside the professional scope of their business.

Store

the section of healthytouch.pl that enables online voucher purchases.

Voucher

a named electronic or printed document issued to the person designated by the Customer, confirming the right to receive a specified Healthy Touch service or to use a specified monetary value.

Electronic voucher

a voucher file sent to the email address entered with the order.

Printed voucher

a physical voucher prepared for collection from the Studio or for shipping.

Business Day

Monday to Friday, excluding public holidays in Poland.

3. Offer and technical requirements

1. The Store offers vouchers for a specific service and duration or vouchers for a selected value, subject to the current offer shown on the website.
2. The description, price, variants, voucher format and delivery charge are displayed before an order is placed. Images are illustrative; the binding details are those in the checkout summary and order confirmation.
3. To use the Store, the Customer needs an internet-connected device, a current browser with JavaScript and necessary cookies enabled, and an active email address. PDF reader software may be required to open an electronic voucher.
4. The Customer must provide true and complete information required to process the order and must not submit unlawful content, infringe third-party rights or interfere with the Store’s operation.

4. Placing an order, conclusion of contract and price

1. An order is placed by selecting the service or value, duration, voucher format and optional personalisation, adding the voucher to the order, entering the required details, selecting delivery and payment, accepting the required statements and using the button that confirms the purchase and obligation to pay.
2. Before placing the order, the Customer sees a summary including the voucher’s main characteristics, recipient details, quantity, price, delivery charge and total amount. The details can be corrected until the order is placed.
3. The information on the website is an invitation to enter into a contract. The contract is concluded when the Seller emails confirmation that the order has been accepted for processing. The confirmation includes at least the order number, selected products, price, payment and delivery method.
4. All prices are final prices in Polish zloty. Shipping a printed voucher costs PLN 20; electronic delivery and Studio collection are free of delivery charges. The total amount is always shown before the order is placed.
5. The Seller may cancel an order before fulfilment if the product cannot be prepared, the supplied data prevents contact, or there is an obvious pricing error. The Customer will be informed promptly and any payment received will be refunded.

5. Payment methods and deadline

1. Available payment methods are displayed at checkout and may include Przelewy24 electronic payments, BLIK phone transfer, bank transfer and other methods made available by the Seller.
2. Electronic payments through Przelewy24 are provided by PayPro S.A., Pastelowa 8, 60-198 Poznań, Poland, National Court Register KRS 0000347935, Polish tax ID NIP 7792369887, REGON 301345068.
3. The payment card operator is PayPro S.A., a Settlement Agent with its registered office at Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, NIP 7792369887, REGON 301345068.
4. For an electronic payment, the Customer is redirected to the operator’s secure service and follows its instructions. The Seller does not receive full card details or online banking credentials.
5. For a bank transfer or BLIK phone transfer, the exact amount must be paid and the order number entered as the payment reference. Payment details are shown at checkout and included in the email.
6. The order is fulfilled after payment confirmation. If payment is not received within 3 days of the order, the Seller may cancel it after first sending a reminder.

6. Preparation, delivery and collection

1. Every voucher is prepared and checked manually after payment has been confirmed.
2. An electronic voucher will be sent to the email address entered with the order no later than the end of the second Business Day after payment confirmation. The Customer should also check the spam folder and contact the Seller if the email has not arrived by that time.
3. A printed voucher for Studio collection will be ready no later than the end of the second Business Day after payment confirmation. The Seller will notify the Customer by email or phone when it is ready at Hetmańska 4/12, Rzeszów.
4. A printed voucher for shipping will be dispatched within 2 Business Days after payment confirmation. The carrier’s expected delivery time is 1–3 Business Days and is additional to the preparation time.
5. If the above timeframe cannot be met, the Seller will contact the Customer promptly and offer a new date or a refund.
6. The Customer should check the voucher details promptly. The Seller will correct typographical errors or details inconsistent with the order free of charge.

7. Voucher validity and redemption

1. Every Voucher is issued to a named recipient, whether it was purchased for a specific service or for a specified value. The Voucher is issued to the person identified in the order or notified to the Studio before the Voucher is issued.
2. A Voucher is valid for 3 months from the purchase date stated in the order confirmation, unless the Voucher or offer description expressly provides a longer period.
3. To preserve the right to redeem the Voucher, the recipient must contact the Studio and book an appointment during the Voucher’s validity, providing the Voucher number. The appointment itself may take place after the 3-month period if its date was agreed and confirmed by the Studio before the Voucher expired.
4. A service Voucher covers the service and duration stated on it. With the Studio’s consent, it may be changed to another service: if the selected service is more expensive, the Voucher recipient pays the difference based on the price in force on the appointment date; if it is less expensive, the unused difference is not refundable or exchangeable for cash.
5. A value Voucher reduces the price of a selected service by the stored value. If the service price is higher than the Voucher value, the Voucher recipient pays the difference based on the price in force on the appointment date. Any unused part of the Voucher value is not refundable or exchangeable for cash.
6. A price change after purchase does not affect a valid Voucher for a specific service. If that service has been discontinued, the Studio will offer an equivalent service, use of the value for another service, or a refund of the unused amount.
7. After expiry, a Voucher may be reactivated for a fee of PLN 30. Reactivation does not extend the Voucher’s validity by a further 3 months; it permits redemption only at one specific appointment agreed with the Studio. That appointment may be rescheduled in accordance with clause 8.2 of these Terms. If the Voucher recipient does not attend the agreed appointment and has not validly rescheduled it under those rules, the reactivation expires, and booking another appointment requires a new reactivation and a further PLN 30 fee.
8. The Voucher may be redeemed by the person named on it. Changing the recipient requires prior contact with the Studio and an update of the Voucher details before the appointment.
9. A Voucher is not exchangeable for cash except where required following statutory withdrawal, an accepted complaint or the Seller’s failure to perform the contract.
10. The Voucher number must be protected from unauthorised use. Losing a printed document does not automatically remove its value if the Seller can verify the purchase and block the previous number.

8. Key rules for Studio visits

1. A booking may require a PLN 50 deposit when the Customer is not using a paid Voucher. The amount and conditions are confirmed when booking and the deposit is deducted from the service price.
2. An appointment may be rescheduled once without charge if notice is given at least 24 hours in advance. In an emergency, the Studio asks the Customer to contact it as soon as possible and will consider the circumstances individually.
3. Failure to attend without notice or cancellation less than 24 hours before the appointment may result in loss of the deposit or the booked Voucher service being treated as used, provided the Customer was clearly informed of this when booking. This does not restrict mandatory statutory rights.
4. Late arrival may shorten the service if the next booking prevents an extension. A delay caused by the Studio will not shorten the paid service duration.
5. Before treatment, the Customer should provide accurate information about their health and contraindications. The Studio may refuse or stop a service where justified by safety or medical contraindications; the parties will then arrange another date or a safe alternative, or agree how to settle the unperformed service if neither is possible.
6. Mutual respect is required. The Studio may refuse service to a person who is aggressive, intoxicated or threatens safety or the personal rights of others.

9. Right to withdraw from a distance contract

1. A Consumer may withdraw from a contract concluded online without giving a reason within 14 days of the date the contract was concluded.
2. To meet the deadline, it is sufficient to send an unequivocal statement before it expires to [email protected] or by post to the Seller. The model form below may be used but is not mandatory.
3. After effective withdrawal, the Voucher will be invalidated and the Seller will refund all payments received, including the cost of the least expensive standard delivery offered by the Store, no later than 14 days after receiving the statement. The same payment method will be used unless the Consumer agrees otherwise without extra cost.
4. If, at the Consumer’s express request, performance of the service covered by the Voucher begins before the withdrawal period expires, the Consumer must pay for the part performed up to withdrawal. The right of withdrawal expires after a paid service has been fully performed where performance began with the Consumer’s prior express consent and acknowledgement that the right would be lost after full performance.
5. Delivery of an electronic Voucher alone does not remove the Consumer’s right of withdrawal if the Voucher has not been redeemed and no statutory exception applies.

10. Complaints

1. The Seller is responsible for conformity of the Voucher and services with the contract under applicable law.
2. A complaint may be submitted by email to [email protected], by post or in person. It is helpful to include the order or Voucher number, a description, the requested remedy and contact details. A missing item does not automatically invalidate the complaint.
3. The Seller will respond to a Consumer complaint within 14 days of receipt, on paper or another durable medium.
4. Consumers may seek assistance from a Polish municipal or district consumer ombudsman, the competent Provincial Inspectorate of Trade Inspection, or the information available at polubowne.uokik.gov.pl. Out-of-court resolution is voluntary and, where required by the procedure, depends on both parties’ consent.

11. Personal data and cookies

1. Yana Kazymyrchuk is the controller of Customer personal data. Data is processed, in particular, to handle orders, payments, delivery, complaints and accounting duties and — on the basis of separate consent — newsletters or analytics and marketing cookies.
2. Details of legal bases, recipients, retention periods and data subject rights are provided in the Privacy Policy, also available from checkout and the website footer.

12. Final provisions

1. Polish law applies to contracts. This choice does not deprive a Consumer of the protection granted by mandatory provisions applicable in their country of habitual residence.
2. These Terms do not exclude or limit rights arising from mandatory law. Mandatory provisions prevail in the event of a conflict.
3. The Seller may amend the Terms for an important reason, including a change in law, payment methods, delivery or Store functionality. An order is governed by the version accepted when it was placed. Changes cannot worsen rights under Vouchers already purchased.
4. These Terms apply from 17 August 2026.
